Understanding Physical Custody and Legal Custody in California

California law distinguishes between physical custody and legal custody. Physical custody refers to where the child lives. Legal custody is the authority to make decisions about the child’s upbringing, which encompasses everything from where the child goes to school to what medical treatment the child should receive.

Here are several possible ways a court might assign child custody:

  • Sole physical and sole legal custody to one parent: The child would live with one parent while the other may get visitation. The custodial parent would also have the sole right to make decisions involving the child’s upbringing.
  • Sole physical custody for one parent, with joint legal custody: The child lives with one parent while the other may get visitation. The two parents share decision making authority.
  • Joint physical and joint legal custody: The child lives with each parent for a certain amount of days a week and both parents share decision making authority.
  • Joint physical custody with sole physical custody: Both parents share decision making authority, but the child lives with one parent while the other may get visitation.
